These Terms of Service ("Terms") are an agreement between you, the parent or legal guardian who creates a Scribblie account, and [CONTROLLER LEGAL NAME] ("Scribblie", "we", "us"). They cover the Scribblie app and the heyscribblie.com website (together, the "Service"). Please read them together with our Privacy Policy. By creating an account or using the Service you agree to these Terms.
1. Who can hold an account
You must be an adult (at least 18, or the age of majority where you live) and the parent or legal guardian of any child who uses Scribblie on your account. Children may use Scribblie only through a parent's account and with the parent's consent, which the app records before any child feature is turned on. You are responsible for your account, for keeping access to your device and sign-in secure, and for supervising your child's use.
2. What Scribblie does
Scribblie lets a child draw a character and see it come to life as a friend that moves and talks with them. We may add, change or remove features over time, and we may suspend the Service for maintenance or safety reasons.
3. Parental consent and controls
By giving consent in the app you confirm that you are the child's parent or legal guardian and that you agree to the collection and use of your child's information as described in the Privacy Policy. Some actions, such as deleting the account, sit behind a grown-up check. You can withdraw consent at any time by deleting the account in the app (Profile > Delete account).
4. AI-generated content
The friend's appearance, movement, voice and replies are generated with artificial intelligence. We design them to be friendly and age-appropriate, but AI can make mistakes and may occasionally say something inaccurate, odd or unsuitable. The friend is not a person, is not a teacher, doctor or counsellor, and is not a substitute for adult supervision. If something worries you, stop using the feature and tell us at support@heyscribblie.com.
5. Your drawings and content
You and your child keep ownership of your child's drawings. You give us a limited, non-exclusive, royalty-free licence to store, process and display them, and the content created from them, only to provide the Service to you. This licence ends when you delete the content or your account, apart from short-lived backup copies described in the Privacy Policy. We do not publish your content and the app has no public sharing.
6. Acceptable use
Please do not: use the Service unlawfully; upload content that is harmful, abusive or sexual, or that shares other people's private information; try to access other accounts or our systems without permission; interfere with or overload the Service; reverse engineer the app except where the law allows; or use automated tools to access it. We may remove content or suspend accounts that break these rules or put children at risk.
7. Price
Scribblie has no in-app purchases, subscriptions or ads at this time. If we ever introduce paid features, we will update these Terms and tell you before you are asked to pay anything.
8. Our rights
The Service, including the app, software, designs, characters we create and the Scribblie name and logo, belongs to us or our licensors. Apart from the right to use the Service under these Terms, no rights are transferred to you.
9. App stores and sign-in providers
You download the app from the Apple App Store or Google Play and sign in with Google or Apple. Their terms also apply to your use of their services. Our End User License Agreement explains the app licence and the terms Apple requires.
10. Ending your account
You can stop using Scribblie and delete your account at any time in the app (Profile > Delete account) or by emailing us; see our Data Deletion page. We may suspend or close an account if these Terms are seriously broken, if needed to protect a child or others, or if we stop offering the Service, in which case we will try to give you notice.
11. Disclaimer
We work hard to keep Scribblie safe, available and working well, but the Service is provided "as is" and "as available". To the extent the law allows, we do not give any warranties beyond those set out in these Terms. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data, profits or goodwill, arising from your use of the Service, and our total liability to you is limited to the greater of the amount you paid us in the previous twelve months and USD 100. We do not exclude or limit liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
13. Governing law
These Terms are governed by the laws of [GOVERNING LAW AND COURTS]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts.
14. Changes to these Terms
We may update these Terms. If a change is significant we will tell you in the app before it takes effect. If you do not agree, you can delete your account.
